Special Court: Why Musharraf allowed to fly abroad?

As the Special Court has resumed high treason case against General (Retd) Pervez Musharraf who left the country of medical treatment.

Three member bench headed by Justice Mazhar Alam in the beginning of the hearing asked government, “Why did Musharraf allowed to go abroad despite having knowledge we have summoned him.”

Akram Shaikh Advocated stated that if court want to record the statement of accuse, can record it via video link.

The court summoned the Interior Minister’s secretary over excluding the name of Musharraf from the Exit Control List (ECL) and adjoined the hearing.

Earlier, The Special Court on March 7 summoned former army chief general (Retd) Pervez Musharraf on March 31 to record statement under section 342 of Criminal Procedure Code. It also declined to accept medical report that had advised the former commando complete rest.

Musharraf went abroad after the top court dismissed the federation appeal against the Sindh High Court judgment, which had asked the government to remove his name from the Exit Control List.

A five-member bench of the apex court, headed by Chief Justice Anwar Zaheer Jamali, on March 16 dismissed the federation’s appeal but ruled: “This order will not preclude the federal and Special Court, which is seized with high treason case under Article 6 of Constitution against Pervez Musharraf, from passing legal order to regulate his custody and restricting his movement.”

The prosecution also said they had completed their case in September 2014. They said four time Musharraf’s counsel submitted to the Special Court that he appear before the court and now they have to defend the case.

The prosecution say that they would urge the Special Court, comprising three high court judges, Chief Justice Peshawar High Court Mazhar Alam, Justice Tahira Safdar from Balochistan High Court and Justice Yawar Ali of Lahore High Court, to order for bringing back the retired general.

The Special Court was established under the Criminal Law Amendment (Special Court) Act 1976 to hear high treason case against Pervez Musharraf for promulgating emergency and Provisional Constitutional Order on November 3, 2007. It has been hearing the case since December 24, 2013.
