LAHORE: A Lahore High Court division bench on Tuesday issued non-bailable arrest warrants of Mustafa Kanju, Sadiq Amin, Asif Rehman and Akram after they failed to appear in an appeal against their acquittal in Zain murder case.
The division bench headed by Justice Syed Mazahar Ali Akbar Naqvi passed the orders on an appeal filed by the provincial prosecution department.
Earlier, Additional Deputy prosecutor Abdul Samad, questioning the trial court verdict in Zain murder case, submitted that the trial court did not fulfil the legal requirements and acquitted the accused after retraction of some witnesses. He said that the court did not give opportunity to prosecution to cross examine the witnesses.
He said the court also did not record statement of other witnesses.
SHO South Cantt Police Station Qamar Abbas informed the bench that Mustafa Kanju had gone abroad, whereas other three accused were also missing.
At this, the bench issued arrest warrants of the accused while directing police to arrest them and produce on April 20.
The provincial prosecution department had filed the appeal submitting that the trial court failed to observe the provisions of law properly and acquitted the accused. The department pleaded the court to set aside acquittal of Mustafa Kanju and others.
