IHC issues detailed verdict of Zardari’s bail plea rejection

The Islamabad High Court (IHC) has issued a seven-page detailed verdict on the bail plea of former president Asif Ali Zardari being rejected in the fake accounts.

The verdict states that the Supreme Court in the Avenfield case had set precedents for bail in cases of the National Accountability Bureau (NAB). Further, the decision of the Supreme Court is also applicable to matters of bail before arrest.

According to the IHC verdict, the furnishing of a bond under section 90 Cr.P.C is not a bar for NAB to arrest petitioners for investigation of the case as the bond is submitted only for personal appearance before the court.

Further, Chairman NAB has the power to effect arrest of any person facing an inquiry or investigation, however, since the referred stage is over and Reference has been filed, hence the Chairman NAB has no lawful authority to execute warrants of arrest.

On June 10, NAB arrested Asif Ali Zardari in the fake accounts case from Islamabad.
