Supreme Court resumes Panama case hearing

ISLAMABAD: The Supreme Court of Pakistan has resumed hearing of Panama Papers case on Monday (today). 

A five-member larger bench headed by Justice Asif Saeed Khosa is hearing the case.

NAB submitted record of Ishaq Dar’s apology in the Supreme Court. According to the record, the NAB chairman had accepted the apology plea of Ishaq Dar on April 21, 2000.

Shahid Hamid, a representative of Ishaq Dar, Maryam Nawaz and Captain (Retd) Safdar, told the court that a disqualification petition against his client Ishaq Dar had been dismissed.

He added that the decision of dismissing references against Nawaz Sharif and others had already been reported.

Justice Asif Khosa observed if the Referee had to give judgment on his point out of view in the money laundering case?

In response, Shahid Hamid told the court that the Referee judge had rejected the NAB’s request for resuming the inquiry, to which Justice Gulzar remarked if the court decision was challenged in the Supreme Court?

The counsel for Ishaq Dar told the court that the decision was not challenged in the Supreme Court as the time period for appeal against the judgment  had lapsed.

Justice Asif Khosa instructed Shahid Hamid to complete his arguments and then the NAB prosecutor general will be questioned.

Justice Ejaz Afzal remarked if Ishaq Dar’s confessional statement was recorded after becoming an approver?

In response, Shahid Hamid told the court that the statement was recorded after becoming an approver. He added that his client cannot be disqualified merely on the grounds of accusations. He informed the court that at the time of charges his client did not has any public office.

The lawyer observed that under the Section 26 of Criminal Code Procedure Ishaq Dar cannot be tried again.

Justice Gulzar remarked if Ishaq Dar were not awarded sentence in the case after apology?

Justice Azmat instructed Shahid Hamid to focus on a point that if a person may be tried twice.

The Supreme Court inquired why NAB, State Bank or SECP did not file any appeal against the decision.

NAB Prosecutor General Waqas Qadeer Dar recorded his statement today.

In response, the prosecutor general of NAB told the court that keeping in view learning of the high court judges the appeal was not filed.

Shahid Hamid, a representative of Ishaq Dar, Maryam Nawaz and Captain (Retd) Safdar, wrapped up his argument.

The PM’s counsel submitted a record having details of the distribution of the Sharif family’s inherited properties.
